Is CBD Oil Legal?

Through these years, CBD is one of the buzzwords that have continued to make the headlines of top magazines, news and blogs not only in the United States, but in other developed countries of the world. It is astonishing to note, however, that in a country where the sale and legal ownership of arms are permitted, the subject matter of the “total legalization of cannabis” still sparks some debate among folks.

From the records, historically, the United States plays the role of the spokesperson for all other countries, especially on matters that affect the interests of people globally. The U. S. has also earned her respects by serving as a powerhouse where realistic decisions are made, and won accolades for being a reputable model. Nonetheless, many believe that despite the fact that the United States is at the forefront in high profile discourse, she still has quite a long way to go in accepting this life-saving plant.

Matters Arising: Is CBD Legal?

The question regarding the legitimacy of consuming CBD is a trending wave that concerns all states of the United States. Why? This is because significant percentage of the U S population is thanking their lucky stars for the hope that CBD products and marijuana extracts has helped raised in different walks of life. Consider autoimmune diseases, for example, which pose serious health challenge to more than 50 million American. Today, CBD oils are ubiquitously effective in serving athletes, seniors, patients and medical practitioners who rely on it for tackling numerous health conditions including relentless body pains, mood swings, anxiety, depression, insomnia, severe migraines and constant inflammation.

Ever since the US Drug Enforcement Administration’s published rule regarding CBD in December 2016, the legal status of CBD consumers in the United States is somewhat confusing. Although the intent of the agency’s rule was to align with the United Nations treaties that govern controlled substances. However, CBD manufacturers, retailers and consumers are lost in the clarity of the rule. Confused yet?

All hopes are not lost

Yes, following the 2018 New Year gift, there seems to be light at the end of the tunnel. The sales of recreational use of marijuana kicked off in California on Jan. 1. The law, which was passed in 2016, materializes in California and could possibly allow the state to inaugurate itself as the world’s largest planting herb market. The large western US state had already pioneered medical marijuana in the United States, allowing it as early as 1996. Twenty-two other states have legalized the drug solely for medical purposes. And thirty states plus the District of Columbia have legalized marijuana in one form or the other.

So far, so good, eight states and the District of Columbia have embraced marijuana for recreational use – an achievement that has applauded standing ovations among CBD hemp lovers. Colorado was the first to vote in 2012 for this amendment on recreational use, followed by Washington. “Now I do not feel like a criminal when I smoke grass,” says Matt Johns, a gentleman from Boulder, a town northwest of Denver, Colorado’s capital. In these two states, as of 2014, adults over 21 years have obtained the right to buy cannabis in accredited stores in limited quantities. In six states, a resident can purchase twenty-eight grams.

In Massachusetts, the residents are allowed to hold 280 grams at home and 28 grams in public. Nonetheless, Maine is legally authorized to enjoy the possession of 75 grams. Recreational use is permitted only in a private place and not in the streets. More so, culture plans must be recorded in a computerized central file. “Nobody calls us if we smoke outside. We do not currently have places for cannabis smokers like coffee shops, but I think it will come in the future, “says Matt Johns.

“Cannabis use is banned by the federal authorities but Donald Trump has assured the prerogative to the states”

Alaska and Oregon legalized recreational marijuana respectively in 2014 and 2015. At the same time as the US presidential election in November 8, 2016, California, Maine, Nevada and Massachusetts nodded in approval to legal cannabis. On December 8th, the West Coast State opened an online platform to collect applications for licenses from companies wishing to work in cannabis industry at the start of January, 2018. Other cities like San Diego, San Francisco and San Jose have already issued the permits so that the concerned traders can start the sales from the early hours of the New Year 2018. Los Angeles is yet to grant the licenses.

Way to go…

Of all the 50 states in the United States, only six states (Idaho, Kansas, South Dakota, Nebraska, Indiana and West Virginia) still prohibit every part of the hemp plant, including the CBD.

Most of these states allow possession, but frown at in-house cultivation, licensed dispensaries and any other marijuana resource. This implies, registered patients can consume it but can’t obtain it legally. You see, more needs to be done.

Some rationales behind CBD prohibition

Some delicate but not elaborate points are also known. According to neuroscientists and researchers, the prohibition policy hinders more concrete and reliable positions on its pros and cons. More recent scientific studies reveal that the hemp plant contains more than four hundred chemical components, seventy of them cannabinoids, which interact with each other and sometimes in a harmful way.

Recreational use can be harmful in adolescents younger than twenty-one years (when there is no complete development of the brain) and who are predisposed to psychotic disorders. There are reports that, although divergent, they point out that frequent use of marijuana causes loss of memory and decreased learning and poor motivation.

It is plausible to admit that humans use the plant recreationally in order to exploit a kind of divine mystery, to leave the reality of an oppressive world, where the roots of it leave the earth and feed from the sky. So much so that there is a strong connection between marijuana and the major ancient religions, or secretly used by priests, who fear the spread of marijuana among the masses, and now as an instrument of reaching out to followers.

Ancient references to the relationship between marijuana and religion are most evident in India. In the Hindu religion, marihuana is associated with the goddess Shiva: one of the most complex and paradoxical figures of the trinity. The story tells that Shiva had quarreled with the family, and after wandering in the fields, seeking shelter from the sun, stopped under a cannabis plant, crushed its leaves and swallowed it.

Marijuana vs. hard drugs

To understand a little more about the restriction and also a little more of those that are against marijuana, we must analyze the so-called “Stair Theory”, which places this drug erroneously as a ladder for other drugs. There are numerous cases in which heavy drug users, such as cocaine, heroin and others, have already had contact with marijuana, but they do not consider drugs that are potentially more addictive and harmful than alcohol and tobacco. Following this logic, we should put sugar, fried foods and coffee, for example, as part of this theory because obviously people have had contact with these substances at some point in their life.

“But up until now, Marijuana is considered as schedule 1 substance at the federal level.”

This thought does not become so logical, since the fact that people who use cocaine and heroin have used marijuana in some period of their lives does not prove that they climbed that ladder. The vast majority of marijuana smokers is limited only to this and even show some disregard for chemically synthesized drugs.

Less traffic, more accidents

Anti-cannabis folks are dreaded by the fact that teenagers, adolescents and younger people would smoke or ingest more marijuana. According to a federal study published at the end of the first two years of full legalization, which spans 2014 and 2015, teenage use declined by 12%. Here, the positive aspects of legalization tend to prevail. This reduction is accorded to the decline of illegal dealers. With the establishment of adult-only stores, traffic is being regulated teens are having a hard time getting supplies.

On the other hand, a study has shown that the number of children accidentally ingesting cannabis in Colorado has increased by 150% since 2014. In Washington State, the record is mixed. Marijuana use would have increased by 2% for 13-14 year-olds and by 4% for 15-16 year-olds following legalization in 2015.

While there’s a decline in the overall teen consumption, the case is different in adults who’re above the age of 18 – especially among random and frequent consumers over 25 years of age. In Oregon, marijuana use increased from 19.5% in 2013 to 23.19% in 2016. Even in Alaska, which saw the number of consumers increase by 19.86% in 2013 to 23, 46% in 2016?
